Bear Bones Systems LLC Warranty, Terms and Conditions
General Limited Warranty
Bear Bones Systems LLC, hereby warrants to the original retail purchaser that the product produced by Bear Bones Systems LLC and operated by the original purchaser will be free from defects in material and workmanship for a period of one or three years following the original retail purchase subject to the requirements, exclusions and limitations stated below. If the product is rented or used for commercial applications, the Warranty is null and void.
THREE YEAR LIMITED WARRANTY
Subject to the requirements, exclusions and limitations stated below, the structure of your Bear Bones Systems LLC product is warranted to the original retail purchaser against defects in materials and workmanship arising from normal use for (3) years from original retail purchase date and is limited to the structural components and their welds.
ONE YEAR LIMITED WARRANTY
Subject to the requirements, exclusions and limitations stated below, all other components of your Bear Bones Systems product are warranted to the original retail purchaser against defects in materials and workmanship by Bear Bones Systems LLC arising from normal use for one year from original retail purchase date.
EXCLUSIONS TO THE ABOVE LIMITED WARRANTY

Damages or wear caused by unreasonable use or failure to perform repairs and or maintenance.

Damages or deterioration due to normal wear and tear.

Defects arising from operator’s negligence, misuse, abuse, overloading, improper loading, accidents, acts of God, or other contingencies beyond the control of the Manufacturer.

Loss of time, inconvenience, loss of use of product, rental of substitute equipment, loss of revenues, or other commercial loss.

Deterioration of finish and appearance due to use and exposure such as chipping, scratching, fading, ice melt products, tar, damages by animals or insects or pressure washing.

Any and all items installed into or onto a Bear Bones Systems product including any and all modifications done by persons or companies outside of Bear Bones Systems LLC.

Transportation of any Bear Bones Systems product to and/or from a dealer or an approved repair facility shall be the sole responsibility of the product owner.
DISCLAIMER OF IMPLIED WARRANTIES AND LIMITATION OF DAMAGES
ANY EXPRESS OR IMPLIED WARRANTY NOT PROVIDED HEREIN, INCLUDING WITHOUT IMPLIED LIMITATION, ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND ANY REMEDY FOR BREACH OF CONTRACT, WHICH BUT FOR THIS PROVISION MIGHT ARISE BY IMPLICATION OR OPERATION OF LAW ARE HEREBY EXCLUDED AND DISCLAMIED. IF THEY CANNOT BE DISCLAIMED, ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR ANY PARTICULAR PURPOSE ARE EXPRESSLY LIMITED TO THE APPLICABLE ONE OR THREE YEAR TERM DEPENDING ON THE PRODUCT OR COMPONENT.
UNDER NO CIRCUMSTANCES SHALL BEAR BONES SYSTEMS LLC BE LIABLE TO PURCHASER OR ANY OTHER PERSON FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER ARISING OUT OF A BREACH OF WARRANTY, BREACH OF CONTRACT, TORT, OR OTHERWISE. THE SOLE RESPONSIBILITY OF BEAR BONES SYSTEMS LLC SHALL BE TO REPAIR OR REPLACE PARTS AT OUR FACTORY IN OGDEN UTAH OR AUTHORIZED REPAIR CENTER. ALL OTHER OBLIGATIONS OR LIABILITIES, INCLUDING INCIDENTAL OR CONSEQUENTIAL DAMAGES OR CONTINGENT LIABILITIES ARISING OUT OF THE FAILURE OF ANY PARTS TO OPERATE PROPERLY, ARE HEREBY EXCLUDED, INCLUDING BUT NOT LIMITED TO ANY DAMAGES RESULTING FROM LOSS OF USE, INCONVENIENCE, LOSS OF TIME, COMMERCIAL LOSS, OR ANY OTHER TYPE OF DAMAGES, GENERAL OR SPECIFIC, FORSEEN OR UNFORSEEN, UNLESS APPLICABLE STATE LAW PROVIDES OTHERWISE. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
No dealer, distributor, representative of Manufacturer, or other person is authorized to make any representation or promise of warranty concerning Manufacturer’s products on behalf of Manufacturer except to refer the purchaser to this Limited Warranty
This warranty provides specific legal rights. You may have additional rights not included in this warranty which vary from state to state. No action to enforce this warranty shall begin more than six months after a defect is discovered and shall not commence after expiration of the stated warranty period.
WARRANTY VALIDATION
The original purchaser must register their product by going to Bear-bones.com and filling out the Warranty Registration or by completing, detaching and mailing or scanning and emailing the Warranty Registration below within 30 days of purchase. Failing to do so will void this Limited Warranty. In addition to validating your warranty coverage, registering your product will allow Bear Bones Systems to provide you with any notice or information that may be needed after the purchase.
WARRANTY SERVICE
In the event that warranty service is needed, the customer must immediately contact the dealer or place of purchase to arrange a time for an inspection to determine what, if any, corrective action needs to be taken. In most cases the dealer should be able to address the issue but if not, you should contact Bear Bones Systems via Bear-bones.com or by writing to Bear Bones Systems 3035 Scott Lane Ogden Utah 84401.
Trailer Limited Warranty
Thank you for purchasing a Bear Bones Systems product. We pride ourselves on innovation and quality in our products and expect that you will enjoy many years of satisfying use of your purchase. However, in the event there is a problem with the product you have purchased, Bear Bones Systems extends to you the following Limited Warranty.

Tow Vehicle Wiring, Tow Vehicle Wear, Damages to any Tow Vehicle, and Damages to any cargo.

Damages or deterioration due to normal wear and tear, salt, road grime, application of or exposure to corrosive chemicals or other corrosive materials, or arising from an accident or use of the product.

Terms and Conditions of Sale
At Bear Bones Systems we require payment at the time of order. Custom and special-order items and production requests that may require longer assembly time require full payment at time of order. Changes to orders must be requested and approved in writing. Change requests made via phone call with a member of customer service must have an accompanying written verification to the order to be considered valid. Standard, non-custom orders may be canceled by written request only and are subject to a minimum $25 administration fee and 10% re-stocking, fee as determined by Bear Bones Systems. Orders with customizable hoop and/or wing options may not be eligible for cancellation. Orders that have shipped are not eligible for cancellation except as determined by Bear Bones Systems and customers are responsible for all related shipping charges, re-routing and/or delivery fees, and administrative costs in such circumstances.
Authorized Returns
Any product return must have prior authorization. In order to file a claim on a damaged product you must ship the product to Bear Bones Systems for repair/return. We require the original purchaser first submit digital photos prior to any authorization of return and must receive a Return Merchandise Authorization (RMA) form prior to shipping any return items to Bear Bones Systems. Any product that have been manufactured incorrectly or is of a defective nature will be repaired or replaced at the discretion of Bear Bones Systems. Bear Bones Systems covers the cost of the part only. Shipping, down time, installation costs, etc. are the purchaser’s responsibility. This warranty does not cover the removal or re-installation of the product. Bear Bones Systems will, at its option, repair, replace or refund the purchase price of a defective product or component, provided you return the defective product or component during the warranty period. Bear Bones Systems warranty excludes the following Bear Bones Systems items: bushings, bearings, bump stops, joints, and hardware. These parts are subject to wear and are not considered defective when worn.
Bear Bones Systems shall not be liable for any loss, damage or injury, whether ordinary, direct, special, incidental or consequential damages, arising from the manufacture, sale, installation, resale, delivery, possession, handling or use of its products. Bear Bones Systems is not responsible for typographical errors in pricing or in content. Warranties, policies and prices are subject to change without notice. Use of your product in off-road conditions may significantly increase wear to critical components of your vehicle, which will require and increase inspection protocol and maintenance schedule. Failure to properly inspect and repair your vehicle may lead to failure of components, which may lead to catastrophic failure. Users should be aware that installation of Bear Bones Systems products may change the way your vehicle handles. We strongly encourage that vehicle occupants wear seat belts at all times and avoid sudden maneuvers. Bear Bones Systems accepts no responsibility for any altered product, improper installation, or improper use of our products.
Bear Bones Systems reserves the right to change pricing at any time and to discontinue, change the design, finish, part number and/or application of parts when deemed necessary without written notice. Minor options and revisions to design may not always be represented in every photo, video, or product representation as product evolves. Bear Bones Systems will not be held responsible for changes or misprints or manufacturing changes made by the vehicle manufacturer.
These Terms of Use and Guidelines apply to all websites (“Sites”) operated by Bear Bones Systems. In this document Bear Bones Systems refers to Bear Bones Systems LLC.
By visiting our website and accessing the information, resources, services, products, and tools we provide, you understand and agree to accept and adhere to the following terms and conditions as stated in this policy (hereafter referred to as ‘User Agreement’).

We do not assume any liability for any content posted by you or any other 3rd party users of our website.
However, any content posted by you using any open communication tools on our website, provided that it
doesn’t violate or infringe on any 3rd party copyrights or trademarks, becomes the property of (Bear Bones), and as such, gives us a perpetual, irrevocable, worldwide, royalty-free, exclusive license to
reproduce, modify, adapt, translate, publish, publicly display and/or distribute as we see fit. This only refers and applies to content posted via open communication tools as described, and does not refer to information that is provided as part of the registration process, necessary in order to use our Resources.
You agree to indemnify and hold harmless Bear Bones Systems LLC. and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.
LIMITATION OF WARRANTIES
By using our website, you understand and agree that all Resources we provide are “as is” and “as available”.
This means that we do not represent or warrant to you that: the use of our Resources will meet your needs or requirements. the use of our Resources will be uninterrupted, timely, secure or free from errors.

LIMITATION OF LIABILITY
In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. Bear Bones Systems LLC. will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.
COPYRIGHTS/TRADEMARKS
All content and materials available on the Bear Bones Systems website., including but not limited to text, graphics, website name, code, images and logos are the intellectual property of Bear Bones Systems LLC., and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by Bear Bones Systems LLC..
TERMINATION OF USE
You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website and Resources with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Resources we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.
GOVERNING LAW
This website is controlled by Bear Bones Systems LLC.. It can be accessed by most countries around the world. By accessing our website, you agree that the statutes and laws of our state, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.
Furthermore, any action to enforce this User Agreement shall be brought in the federal or state courts you
hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
SHIPPING POLICY/DELIVERY POLICY
All Products are shipped FOB Ogden, Utah, with freight and insurance prepaid and added to the invoice as a separate item. The cost of any special packing or special handling caused by Customer’s requirements or requests shall be added to the amount of the order. Shipping to apartments or difficult to access units and outlying areas ( for example requiring ferry service, apartment complex, or military bases) may incur additional shipping fees for which the Customer is responsible, as well as fees related to undeliverable orders as a result of failed delivery attempts, missed delivery appointments, and/or inaccurate delivery address or phone numbers as well as fees related to inside delivery to commercial locations or misclassification of shipping destinations.
International
Import/export laws are different in each country. It is your responsibility to check with your Customs office to verify whether the country to which you are shipping permits the shipment of the products you order. Bear Bones Systems LLC is not responsible for any direct, indirect, punitive, or consequential damages that arise from improper international shipping practices.
Customs and import duties may be applied to International orders when the shipment reaches its destination. Such charges are the responsibility of the recipient of your order and vary from country to country. Contact your local import/customs office for details.
REFUND POLICY
With some exceptions, unused Products may be returned within thirty days of purchase with prior authorization (RMA) Return Material Authorization. Returned Products must be suitable for resale as new. A 20% or $40 (whichever is greater) restock fee will be charged on all returns for items retailed over $99 and a 10% re-stock fee on items below $99.00. Credit will be given only to the billing party on the invoice. Credit will not be given any product damaged or unsuitable for resale as new. To file a claim on a damaged or faulty product it is required that the original purchaser first submit digital photos and request a Return Merchandise Authorization (RMA) form and number. Purchaser must then ship the product to Bear Bones for repair or replacement (at Bear Bones’ discretion). Email photos and RMA request to Bary@bear-bones.com. Return of unused and unopened products also requires an RMA.
PRIVACY POLICY
Bear Bones Systems LLC. (“us”, “we”, “our”) provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of Bear-bones.com (“site”). This Privacy Policy applies only to information that you provide to us through this site. This Privacy Policy may be updated from time to time. We will notify you of any material changes by posting the new Privacy Policy on the site. You are advised to consult this policy regularly for any changes. As used in this policy, the terms “using” and “processing” information include using cookies on a computer, subjecting the information to statistical or other analysis and using or handling information in any way, including, but not limited to, collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within our company within the United States or internationally.

We constantly review our systems and data to ensure the best possible service to our customers.
